High Court Judgement

High Court Judgement about the release of the Watson Report on the discontinuance of the promotion of Summit Quinphos SustaiN

The Judgement of Mr Justice Miller about the release of Dr Catherine Watson's report into the promotion of Summit Quinphos  SustaiN  was released yesterday. The Judgement is available on the Fertiliser Quality Council website [link] . The judgement follows an application to the High Court by Agrotain International and Summit Quinphos for an injunction to prevent release of this report.

The Fertiliser Quality Council commissioned an independent international expert to review the research results of Summit Quinphos SustaiN, to determine the integrity of the trials, and interpretation of trial results. The Review was conducted by Dr Catherine Watson, Head of the Agri Environmental Branch, AFBI, Agri Food and Biosciences Institute, Belfast. Dr Watson is a pre-eminent scientist in the development of urease and nitrification inhibitor products

Dr Watson's report follows a complaint to the Fertiliser Quality Council, that the promotion of a Fertmark registered product, Summit Quinphos SustaiN overstated pasture growth response. The Fertmark scheme provides an independent audit of nutrients in Fertmark registered fertilisers sold in New Zealand. The Fertiliser Quality Council manages the Fertmark Code of Practice to ensure that farmers receive high quality independent advice about nutrients in the fertilisers they purchase.

The Fertiliser Quality Council is concerned that farmers should receive high quality information on which to base fertiliser buying decisions.  The Fertiliser Quality Council feels it is necessary to bring the High Court Judgement and Dr Watson's report to the attention of the farming public.  The independent review of the Summit Quinphos SustaiN trials conducted by Dr Watson together with  the High Court Judgement may be found [link]
